Chapter 22
Privacy
Subchapter
B Insurance Consumer Health Information Privacy
22.51 Purpose
and Scope
22.52 Definition of terms
22.53
Authorizations
22.54 Required Parts of an authorization (they cannot be valid for
longer than 24 months)
22.55 Delivery of Authorization
22.56 Revocation of Authorization
22.57 Exceptions to be the need for authorization
(a) Underwriting
- seems that there should be an authorization utilized for releasing/requesting
information for this purpose - not an exception.
(b) Utilization
Review - This is a little broad and could be over-utilized without
some type of qualifying statement naming their group as their agency,
etc.
(c) Policy Holder
Services - This is just too broad of an area to listed in an exception
for the need of an authorization. Many requests could use this division
as a reason to receive information without an authorization.
(d) Claims Administration,
Adjustments and Management - Again, this is just too broad of an
area to be listed in an exception for the need of an authorization.
Many requests could use this division as a reason to receive information
without an authorization.
Effective February
3rd, 2002.
